This course is the approved (FS 491 Board) Florida "Laws and Rules" initial licensure requirement for Social Workers, Marriage & Family Therapists and Mental Health Counselors in both venues (live and online broadcast).
A minimum of five registrants required for online broadcast. This course utilizes SKYPE a free download applet. The instructor will initiate the call to students. Students must have a microphone and speakers (built in equipment is fine) to communicate with the instructor. Handouts are emailed prior to the class.

Description:
A required curriculum for candidates for Florida licensure in Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling, this 8-hour class presents the pertinent laws and rules to aid professional counselors in avoiding malpractice problems, adherence to licensure requirements and protection of clients' welfare. The laws and rules for behavioral health practice legislation and relevant administrative code include: F.S. 455 Part II, F.S. 491, F.A.C. 64B4. The module on behavioral health services legislation includes: F.S. 394, F.S. 397. The third module includes psychotherapist - patient privilege, child and elder abuse reporting requirements as per F.S. 90.503, F.S. 415 and F.S. 39, concluding with highlights of several other state and federal laws that may be relevant.
Objectives:
Professional Practice Legislation
Participants will be able to discuss F.S. 456 which establishes the regulation of the health professions through the Florida Department of Health, empowered to license and regulate health practitioners
Participants will be able to discuss F.S. 491, governing the practices of clinical social work, marriage and family therapy, and mental health counselors
Participants will be able to discuss F.A.C. 64B4, which establishes the Florida Board for LCSW, LMFT and LMHC, and defines it's authority, procedures, and activities, and includes practice definitions, and requirements for licensure and supervision
Behavioral Health Service Legislation
Participants will be familiar with F.S. 394, Part 1 that establishes, defines, and mandates state and community mental health services including relevant implications to professional practice
Participants will be familiar with F.S. 397, which provides for substance abuse services, including procedural information about the Marchman Act
Confidentiality and Abuse Reporting Requirements
Participants will be able to discuss the psychotherapist-patient privilege as per F.S. 90.503 including specific applications to clinical practice
Participants will be able to describe the requirements for reporting child and elder abuse and other related provisions as per F.S. 415 and F.S. 39
